School Committee Gives Initial Nod to Proposed New Rink/Rec Center

The Belmont School Committee gave its initial “OK” Tuesday night, Sept. 8, for a youth sports organization to begin the process that could result in the construction of a new multi-purpose town recreation center. 

“We are not just looking at our needs, but … of the entire community,” said Bob Mulroy, who gave the presentation for Belmont Youth Hockey Association, which is leading the project that would include an NHL-sized skating rink, a second “half” skating surface that would transform into a field house for half the year, modern locker rooms, a community fitness center, and many more amenities.

While the proposal has received high marks from public and elected officials in August when the Board of Selectmen was presented with the proposal, those deciding the fate of the project are taking a long-view of the process. 

“I see this as the first step … I don’t see this as a significant substance discussion but just to understand what the proposal is before us,” said School Committee Chair Laurie Slap, as the committee members voted the proposal was “worth exploring.”

The $6.5 million complex – which would include off-street, on-site parking – would be overseen by a non-profit public/private partnership that would incorporate a wide array of town departments, the school committee, youth hockey and funders on the board.

In exchange for the land to build the center, Belmont schools, and high school teams will have use of the facility at no cost. 

Both sides acknowledge the first significant hurdle to clear is where to locate the center. Under BYHA’s ideal scenario, the complex would be built on the current home of the Belmont High softball team abutting the Mobile service station and across Concord Avenue from the Belmont Public Library.

But that is the same site where in May 2013 the school committee rejected a request by the Board of Library Overseers to place a new $19.5 million town library, actually killing the hopes of supporters for more than a decade.

The alternative location would place the recreation center on the existing rink footprint, across Concord Avenue from the Underwood Pool.

“We are aware that fields are crucial in town, and we are not looking to reduce that [amount],” said Mulroy.

The proposal would both help find solutions to real recreational needs – providing adequate changing space and locker rooms for all sports teams – in Belmont as well as replace the 45-year-old “Skip” Viglirolo Skating Rink, which Mulroy described as “toast.”

The rink, with gaps in the walls, few comforts, and antiquated mechanical systems, has past its useful life “long ago,” said Mulroy.

Belmont Youth Hockey is the rinks biggest customer, taking three-quarters of the available rental time.

Mulroy told the meeting the cost to renovate the current structures to current code would be the same as building a new recreation center. 

Under the current blueprint, the proposed center would include:

  • A 25,000 sq.-ft. NHL-sized rink (approximately 200 feet by 85 foot).
  • A half-sized skating rink used for seven months then transformed into a field house for tennis, soccer and community events.
  • Six modern year-round locker rooms.
  • A 5,000 sq.-ft. health club/gym open to the public.
  • Exercise classrooms.
  • A skate shop.
  • Concession stand.
  • Meeting rooms.
  • Athletic offices.
  • A trainers/medical center.

The proposed building would cost between $8 and $9 million, with construction priced between $6 to $7 million financed with private debt. The cost of field renovations would be $1 million with the funds coming from a Community Preservation Committee grant and the final $1 million used to outfit the new space and purchase equipment.

The reasoning behind adding a second, smaller rink to the NHL-sized sheet of ice is financial, said Mulroy. Under economic models of similar existing arenas in New England, Mulroy said the Recreation Center will take in just over $1 million in income annually with expenses of $600,000 for a net “profit” of just under $500,000 a year. 

Mulroy told the Belmontonian after the meeting that several funding sources are prepared to step forward to provide the debt financing. 

Mulroy said he anticipated the planning and design stage – when the details on financing, governance, and zoning will be hammered out – to take a year with construction an additional nine months. He believes the entire project will take 24 months to complete.

From the town’s perspective, the private/public venture is a win/win on many fronts; it is financially sustainable without requiring town funding to run, it takes an enormous expense off of the town’s “to-do” list of capital projects, and it provides Belmont with a new facility at limited cost.

While amenable to the project, School Committee members joined Board of Selectmen Chair Sami Baghdady that many details on financing, governance and a myriad of issues “will need to be flushed out over time” before final approval is granted. 

Member Elyse Shuster suggested that the school committee use the proposal to begin a discussion on the “whole [Belmont High School] campus” as an integrated whole. 

“I would encourage us to think about integrating the [the high school’s Higgenbottom Pool] and making it a true recreational facility,” she said.

Selectmen Agree To Sell Municipal Parking to Cushing Village Team

Eight years after it was first proposed and 24 months since receiving the town’s go-ahead to begin construction, the developers of the proposed 164,000 square-foot Cushing Village multi-use project have the critical piece of town-owned property in its hand to possibly begin work on the long-delayed development. 

Without a representative of the development partners present for the landmark event, the Belmont Board of Selectmen voted at its Monday, Aug. 17 meeting to approve a purchase and sale agreement for the municipal parking lot at 116 Trapelo Rd. to Starr Capital Partners LLC., a Massachusetts Foreign Limited-Liability company based in Acton that registered in by the state in June.

“This is a major step forward for both Cushing Square and the town,” said Selectmen Chair Sami Baghdady. 

“It’s a long time coming,” said Selectman Mark Paolillo. 

The cost of the lot is $850,000 with total revenue to the town – including fees and permits – could reach $1.3 million, according to earlier estimates.

In addition, the town will “not tender the deed to the parking lot unless the financing closes … to give us the insurance that this project is actually going forward, and something doesn’t happen in the interim,” said Baghdady.

“I think that was key to the deal … and we did what was needed to be done,” said Selectman Jim Williams. 

According to the board, Wells Fargo Commercial is the primary lender with Cornerstone, one of the largest diversified global real estate managers, providing the secondary lending component. 

“We’re comfortable … with folks that we want to be involved with, and I’m happy that we are finally moving forward,” said Paolillo.

The agreement includes an easement to the town “in perpetuity” for 50 parking spaces in the project’s underground garage. 

In addition, the town will “not tender the deed to the parking lot unless the financing closes … to give us the insurance that this project is actually going forward, and something doesn’t happen in the interim, said Baghdady.

If the development is once again “unreasonably” delayed, the development team will be charged a monthly fee of $33,000 up to $800,000 in damages if the project ceases.

There is no information when construction will begin at the site at the corner of Common Street and Trapelo Road.

The project includes three buildings: at the municipal parking lot, at the corner of Trapelo Road and Common Street, and the intersection of Common and Belmont streets. The development will include approximately 38,000 square feet of commercial space, 115 dwellings units (60 two bedroom units and 55 one bedroom units) that includes 12 affordable units and 225 parking spaces as a result of the sale of the municipal parking lot. 

This is the second time the board has voted on selling the parking lot to a team led by Acton’s Chris Starr. In October 2010, the board voted to end negotiations with Starr’s Cushing Village Partners.

A week later, Starr files a lawsuit against the individual Selectmen alleging bad faith actions during the purchase negotiations. Six months after threatening the board, Starr and the town signed a preliminary purchase and sale agreement for a parking lot in March 2011.

It would take nearly a year before Starr submitted an application in January 2012. And it would take 18 months for the town’s Planning Board to approve a special permit to allow the project to be built in July 2013. 

The project was delayed another 25 months as Starr found it difficult to obtain financing for the project. After attempts to sell the project or find an equity partner, Starr joined forces with Cambridge-based Urban Spaces, in the spring of this year. 

Belmont Light to Customers: Cool It Using Electricity During Peak Heat

The summer’s first official heat wave – three consecutive days of 90-plus degree temperatures – is expected to put a mighty mechanical and monetary strain on Belmont Light, the town’s utility.

In anticipation of Monday and Tuesday, Aug. 17-18, being high electricity usage days, Sagewell, Inc. –the Woburn-based administrator of Belmont Light Energy Efficiency – is asking its 11,000 customers to help Belmont save energy and money by reducing their electricity consumption on the first two days of the week between 3 p.m.and 6 p.m. 

Electricity cut during peak times helps Belmont mitigate rising utility costs, according to Sagewell.

“Nearly one-third of your electric bill is for the cost of procuring sufficient capacity for peak days and these costs are continuing to increase for all utilities across New England,” Sagewell notes.

Here are some tips to reduce Belmont peak electricity consumption:
●     Adjust air conditioners between four p.m. and 6 p.m. and turn off the AC in rooms that are not used. Adjusting the thermostat even by 2-3 degrees helps.
●     Use a microwave oven or an outdoor grill instead of a stove or a regular oven.
●     Shift laundry and dishwasher use to after 6 p.m.
●     Shift other electricity use to before 3 p.m. or after 6 p.m.

Slip Sliding Away! New Underwood Pool Closed ’til Saturday, Aug. 15

Only one day since opening to rave reviews and a full house, the town has decided to temporarily close the new Underwood Pool until Saturday morning, Aug. 15.

But for those who visited the facility on Monday, the reason for the closure is fairly obvious. 

The three-day shut down will allow contractors and town employees to apply non-skid material to pool surfaces after several residents who first arrived at the pool Monday nearly slipped and fell since their feet could not grip on the smooth pool surface, especially at the entry of the “kiddy” pool. 

The Higginbottom Pool (located at Belmont High School) will be open for public and lap swimming Wednesday, Thursday, and Friday, August 12-14, from noon until 8 p.m.

Special Town Meeting Passes Article Urging Return of ‘Original’ Center Design

Setting aside concerns it was descending a “slippery slope” of interfering with town governance, the Belmont’s Town Meeting members declared Thursday night, Aug. 6, that its opinion would be heard.

At the end of the three-and-a-half hour session, the Special Town Meeting passed a citizen’s petition, 112 to 102 (with 4 abstentions) to “urge” the Board of Selectmen to reconsider its decision on May 28 making significant changes to the Belmont Center Reconstruction Project.

Those changes included the retention of a cut through road between Concord Avenue and Moore Street and including parking spaces to a location originally set aside for the creation of a new “Town Green” in front of the Belmont Savings Bank.

“We’re all thrilled and relieved that Town Meeting voted in favor of the original plan,” said Paul Roberts, who with Bonnie Friedman, led the petition effort.

“I think this was really a vote about respecting the process in how we do big projects in town,” he said.

While the article is non-binding – and there is an indication the selectmen will not change its earlier decision when they meet on Aug. 17 – those on both sides of the debate said the vote will almost certainly affect how Town Meeting takes up capital projects from now on.

“In the future, [Town Meeting is] going to be very clear that we are only funding a particular plan and if there are any major design changes, you have to come back to Town Meeting,” said Friedman.

With Belmont expected in the next few years encounter several large capital projects before Town Meeting and voters – including a skating rink, new high school and a Department of Public Works headquarters – the Board of Selectmen is not eager to see another confrontation with the members on design issues.

“The lesson we learned is that when we come to Town Meeting with a project, we should be as close to finalized as possible,” said Selectman Mark Paolillo.

“Appropriation is really based on a design because we are asking for the money for a specific plan. This project was 90 percent designed when the funding was attached and we kept hearing that we needed a meeting to address concerns of our seniors,” said Paolillo, who said he did not regret his vote making the late minute change to the project.

In 2014, incorporating the work of the Traffic Advisory Committee and other groups, the Board of Selectmen OK’d for the town’s Office of Community Development created plans making up the $2.8 million reconstruction project. At the Nov. 17, 2014, Special Town Meeting, the members approved by a margin of five votes a $2.8 million financing plan for the project based on the designs presented.

Several residents at the time had questions concerning the design, specifically the loss of nine existing parking spaces adjacent to the front of Belmont Savings Bank and the so-called access road running in front of the bank.

Despite a promise to have a community meeting to discuss the issues in the winter before bids were accepted, the gathering did not occur until the May 28th meeting after a petition from Washington Street’s Lydia Ogilby with 200 signatures was presented to the board asking to save a grove of trees (which had already been taken down) and the drive through.

Despite both the selectmen and public viewing the new plan that evening and with construction already underway, the Selectmen voted to re-establish the roadway and add four parallel parking spots as a courtesy to seniors.

The resulting change prompted angry supporters of the original design to circulate its petition – with nearly 400 residents – at first to secure a public meeting with the Selectmen before working towards calling a Special Town Meeting.

In a peace offering presented at the meeting, the petitioners sought to lower the temperature that the confrontation had produced in the past two months – Town Moderator Mike Widmer advised the members to “recognize and respect that we have honest difference and we honor those differences” by “taking a positive approach to our debate” – by swapping a single word from the original article, no longer “directed” but to “urged” the selectmen to reconsider its earlier vote since “nobody in this room wishes to rewrite the laws by which this town has long operated,” said Roberts.

Yet Roberts, in his opening remarks, said Town Meeting needed to be heard after weeks of laboring and lobbying to restore the original vision of the center.

“This Special Town Meeting is the last remaining option available to voters to make sure that a conversation that desperately needs to take place is not silenced,” he said.

In response, Selectmen Chair Sami Baghdady reiterated the board’s contention the changes were well within its rights to alter the design as the board, under the town bylaws, has oversight control over such capital projects.

“Our decision is what we think is best for Belmont, Belmont residents, and the Center,” said Baghdady.

Rather than debate the issues of the competing plans, “I urge you to support the authority of the Board of Selectmen to do its job,” said Baghdady.

For supporters of the petitioners, the debate was fought on two levels; design and process. For Gi Yoon Huang, a mother of two young children, the original blueprint would create a green space protected from traffic in which people could use for passive activities such as eating lunch, taking a break, relaxing; a community space that draws residents into the location.

“Plan A can become a vibrant and vital part of the community where people can spontaneously gather and provide energy … to the community. Plan B will be a dead space,” said Yoon Huang.

Jack Weis said while the board appears to have the authority to make the change from plan A to B, members was told at the November’s Special Town Meeting the design was “90 percent complete” with only inconsequential “nonmaterial modifications” remaining as it approved the financing.

“[T]o insert new traffic circulation and reduce the amount of green space that was a stated key objective, that now constitutes a material change,” said Weis, stating Town Meeting members would have voted that plan down back in November.

“Regardless, if you think Plan A or Plan B is better, it’s important to respect what Town Meeting approved … and we ought to give the benefit of the doubt to the plan that was the result of years of discussion and analysis as oppose to 90 minutes of discussion at a Board of Selectmen meeting,” said Weis.

For those supporting the alternative, the selectmen’s acceptance of Plan B was the culmination of a promise by the Board and Town Meeting to hear and judge the concerns from the a segment of Belmont’s elderly.

Resident Joel Semuels, who serves on the Council on Aging, said the council never had the opportunity since the November meeting to “raise the facts” of safety and accessibility that the COA felt was not fully investigated by town officials and committees.

Paolillo reiterated his support for the alternative plan as “being what’s best for the overall community. It’s not where or not I agree or disagree with Town Meeting.”

Other members, while amenable to either plan, protested the notion Town Meeting has the authority to press the Selectmen to alter their opinion.

“The process for me is far more important to me than [the selected plan],” said Bob McLaughlin.

“The Board of Selectmen get elected; they do their job. If you don’t like, talk to them in April [when Town Election is held],” he said.

“If a camel is a horse designed by a committee, what’s the horse going to look like if this is the way we run our town government?” asked McLaughlin.

When the vote was taken, and the outcome revealed, the petitioners felt Town Meeting had revealed to the selectmen the direction it wants the reconstruction to proceed.

“We wanted nothing more than to show that major changes can not be done without Town Meeting oversight,” said Roberts.

Underwood Pool Opens for Swimming, Fun Monday at 9 AM

No Deal as Selectmen Await Financing Proof From Cushing Village Developer

Despite taking out demolition permits and hiring a Needham-based firm to take down the abandoned buildings, the developer of the proposed Cushing Village multi-use complex still doesn’t hold the deed for the commuter parking lot at Williston and Trapelo roads of the $80 million project as the Belmont Board of Selectmen has yet to see a finalized financial package they can be comfortable.

“The Board is not prepared to vote on the sale of the parking lot at this time,” said Belmont Town Administrator David Kale told the Belmontonian, after the Selectmen met with Town Counsel George Hall for nearly an hour in executive session. 

Currently, a partnership of original developer Chris Starr and Urban Spaces of Cambridge are attempting to put together a financing package for the development which will bring 115 units, 38,000 sq.-ft. retail space and 235 parking spaces to three parcels at the corner of Common Street and Trapelo Road in the heart of Cushing Village. 

The price tag for the parking lot adjacent Starbucks – set six years ago when the parcel went out to bid  – is $850,000; along with fees and permits, the final price is closer to $1.3 million.

While unable to go into detail on a possible agreement, the leader of the Selectmen said any sale will coincide with a financial package.

“We are going to proceed with the closing of the parking with financing in place. That’s the only prudent way we can move forward,” said Selectmen Chair Sami Baghdady, after the meeting.

Baghdady said in addition to the financing package, there is a land development agreement in which the development team must follow to the letter the 26-page special permit. Starr will also convey to town use 50 parking spaces in the underground parking garage and the creation of a parking management agreement as part of the purchase-and-sale agreement. 

“What I have been told is that those documents are not in final form,” said Baghdady. 

While the development partners have yet to have its financial “Ps and Qs” together, it has moved forward by paying for and pulling a demolition permit, hired a firm and has agreed to ground rules on behavior at the site while deconstruction is underway. 

But Kale said the taking of a permit does not indicate the development team will soon possess a building permit.

“The take out these permits at their own risk,” said Kale.

Due to a “lack of information” during the two years since the special permit was issued on July 29, 2013, the town’s Community Development Office has created a page on its website that will be the library for permits and documents related to demolition and construction. 

“As we reach these milestones, we will post all the supporting information that was required that allowed us to give us the approvals for those particular items,” said Glenn Clancy, the Community Development director. 

For Stone, Taking A Gap To Focus on the Practice of Programming

Wearing a black T-shirt and white pants, Jack Stone – who graduated from Belmont High School in June – is both informal and approachable, just like the apps he creates.

(An app is a software program that’s designed to perform a specific function directly for the user, such as a map, games or reviewing when the next MBTA bus will arrive at your stop).

During his time at Belmont High, Stone started the school’s first computer club and helped write the curriculum for the coding course currently being offered.

Though the school does not necessarily have to teach specific programming languages, “the underline principles of computer science rather than programming” would be beneficial to students “in all facets of life,” he said.

Stone believes high school students should have a background in computer science and the Belmont School District should establish more courses in this field in both the middle and high schools to reach this goal.

“It’s the most efficient way of solving problems,” arguing that computer science is a different way of critical thinking that can be applied in all fields of learning. 

Jack’s interest in programming traces back to eighth grade at the Chenery Middle School when he created his first computer games. While he loved computer games, Stone realized he did not just want to “use someone else’s work,” but to “create [his] own.”

Creating apps blends Jack’s favorite things about programming because he likes to do everything: write the frontend and backend, design interface, marketing and packaging. Inspirations sometimes stream through Jack’s mind when he’s “sitting on a couch.”

Once he starts working on a project, he dives through the process on his own. An app usually takes a week or two to create, followed by a lot of revisions as he relies on his friends’ feedback.

Some of Stone’s apps include a physics equations solver and a JavaScript screen recorder, each sharing features of practical convenience and easy use, with polished interfaces and functionality. 

“What I strive to do with my projects is to improve people’s lives,” said Stone.

Growing up with parents not versed in programming, Jack picked up programming online and through books, integrating theory with practice. 

As a self-taught programmer, he sometimes struggles when confronted with technical difficulties, and Google search is his first and only way to get help. Since Belmont does not offer AP Computer Science, it is hard to find a programming expert, be they teacher or student, to consult.

To gain more practical experience in computer work, Stone is taking a “gap” year to intern at a software firm before attending Harvard College in the fall of 2016.               

For Stone, the coming year will be a chance to “get a break from working incredibly hard in the past four years.” It will also give him an opportunity to focus on music and traveling. A nationally-recognized bass trombonist, Stone is seeking to improve his playing before auditioning for Harvard’s orchestra.

Devoting a year to explore his interests will not only boost his competitiveness in college, but also lay the foundation for a future career. Working at software companies will allow him to gain real-world experiences such as writing code for collaborative projects and establishing interpersonal networks. 

Stone hopes to gain “fresh perspectives” that can help him to develop his new software that “simplifies the sharing of information between people.”

Two Years Late: Cushing Village Taking First Step Towards Construction

Exactly two years to the day after the town’s Planning Board approved a special permit granting him permission to begin construction, the developer of the troubled Cushing Village complex will be before town officials early next week seeking to purchase a critical piece of town-owned property so he can finally begin construction on the long-stalled project. 

The Belmont Board of Selectmen’s Monday, July 27 meeting agenda calls on the board to initially meet in executive session before proceeding to vote whether or not to sell the municipal parking lot at Williston and Trapelo roads to a newly-formed partnership consisting of original developer, Smith Legacy Partners, and its new business associate, Cambridge-based Urban Spaces.

The price tag for the parking lot adjacent Starbucks – set two years ago – is $850,000; along with fees and permits, the final price is closer to $1.3 million. The property will house the first of three buildings making up the 186,000 square-foot retail/housing/parking development in the heart of Cushing Square.

The vote to sell the property marks the two year anniversary when Smith Legacy’s Chris Starr was granted the 25-page special permit from the Planning Board at the culmination of an 18-month design review phase on the project made up of 115 residential units, 38,000 sq.-ft. of retail space and 235 parking spaces. 

At the time, Starr proclaimed an accelerated project schedule. Starr told media outlets construction on the first building – located on the parking lot – would be open for retail businesses and resident housing by the late fall/early winter of 2014. The entire project would be completed by mid-summer 2016, said Starr.

But it soon became apparent Starr was unable to find a financial source willing to back him due to his lack of experience building large-scaled projects. In March 2014, Starr struck a deal with the town to extend the closing on the parking lot by a month for a $20,000 fee. The fee increased to $30,000 a month after a year.

By Sept, 2014, Starr hired a Boston realty firm, Boston Realty Advisors, to unearth a partner or sell his stake in the development. The campaign went international with large ads on a leading Asian real estate website.

In the end, a young development firm, Urban Spaces, joined with Starr. It remains unclear the partnership arrangement between the two, including whether there is a majority stakeholder or arrangements for future management of Cushing Village. 

And it does not appear the partnership has been damaged with the arrest of Urban Spaces’ CEO and founder, Paul Ognibene, who was arraigned last week on one count of sexual conduct for fee after he was arrested by Cambridge Police in a sex sting.

Impact on Cushing Village Unclear After Financial Partner’s Arrest

Cushing Village has possibly suffered another setback with the arrest Tuesday of the Cambridge developer seen as the financial “White Knight” who in April appeared to rescue the 167,000 square-foot multi-use project floundering for nearly two years after it was approved by the town in July 2013. 

Paul Ognibene, 43, of Cohasset was arraigned in Cambridge District Court on Friday, July 17, on one count of sexual conduct for fee after he was arrested by Cambridge Police in a sex sting that took place in the food court of the CambridgeSide Galleria mall.

Cambridge Police allege Ognibene, the owner and principal of Cambridge-based Urban Spaces, placed a job description on Craigslist job soliciting an office assistant that an investigation by the police’s special investigation unit determined to be a “false job which is actually soliciting girls for sex.”

Ognibene, who resigned as chair of the Cohasset School Committee on Friday as a result of this arrest, pled not guilty and was released on personal recognizance. His attorney released a statement saying Ognibene “was sorry” for what had occurred.

It is unknown at this time if Ognibene’s arrest could impact any financial arrangements he has made with lenders concerning Cushing Village. It is not unusual for business agreements to be altered or pulled due to adverse publicity. This month, Macy’s parent company ended its business partnership with New York developer Donald Trump after the Republican presidential candidate made sweeping allegations concerning Mexicans who entered the US illegally across the US/Mexican border.

On April 27, Cushing Village’s developer Smith Legacy Partners said Urban Spaces had become its “development partner” in constructing the three-building complex comprising 115 apartments, approximately 36,000 square feet of retail/commercial space and a garage complex with 230 parking spaces. 

Urban Spaces’ “development expertise will help to ensure that the vision we have for the Cushing Village project becomes a reality,” said Chris Starr, the managing partner of Smith Legacy Partners which is located in Acton.

The press release noted that Urban Spaces “acquires, develops and manages high-end residential properties in close proximity to urban centers.”

The April announcement appeared to be a turning point for the troubled development which been paying the town $20,000 a month since March 2014 in a series of  30-day extensions for the closing date of the purchase and sale agreement for the municipal parking lot. The development’s financial issues have been well chronicled from missing repeated ground breaking dates to hiring a high-powered real estate firm to find an equity partner.
