Belmont Police Officers Increasingly Targeted With Verbal Abuse From The Public

In the past few months, Belmont Police officers have been receiving an increasing amount of verbal abuse from some members of the public, according to Belmont Police Chief James MacIsaac in a report to the Select Board.

Officers report they often receive the “middle finger” or people yell “something derogatory at them on a weekly basis,” said MacIsaac.

In one of the most blatant incidents, almost daily a person driving along Concord Avenue stops, or slows down, at the detail officer and shouts “F–k you, murderer!” or “ACAB” which, according to Board Chair Roy Epstein, “stands for something you can look up … because it’s not a nice term.”

Additionally, anti-police graffiti has been tagged in town with the aforementioned “ACAB” that was recently painted on the underpass of the commuter rail bridge at Belmont Center.

And in one case, the abuse turned physical, according to MacIsaac. On Friday afternoon, Sept. 11, a patrol sergeant responding to an emergency call was driving on Waverley when somebody threw a full cup of coffee across his windshield.

While Belmont Police have experienced the occasional incident by a member of the public, rarely has it been sustained over time and committed by several people.

The reaction from the Select Board was one of dismay that members of the community would attack public safety officers.

“I’m astonished that you think behavior like that is appropriate for a police force that is highly professional, highly courteous, and does a great job,” said Epstein.

“I understand that there is a lot of protest going on nationwide. But I think we need to make sure that we continue to treat the officers in Belmont with the appropriate level of courtesy and respect for the professional job that they deliver to the community,” said Tom Caputo of the Board.

Select Board Member Adam Dash pointed out that MacIsaac and the department have been very supportive of all those police reforms, including when in June high school students held a rally for Black Lives Matters.

“To lash out at them over something like that, it was just barking the wrong tree entirely,” said Dash.

Epstein believed that most Belmontians are supportive of the department and should take the time to demonstrate that fact.

“I would ask is for other members of the public, is when you go by a police officer, maybe you can slow down and say something nice to them, and show that they’re actually appreciated,” said Epstein.

Special Town Meeting Likely To Take Up Ending Civil Service For Police, Fire; Trailers Staying On Woodland

Those hoping Belmont’s Special Town Meeting to be held on the last full day of summer (Sept. 21) would “be so easy” with a few procedural articles that would get passed without much trouble can put those dreams away as it appears there’s likely to be a “knockout drag out” over the future of a long-standing labor hiring practice in town.

Among the draft proposals for the Town Meeting, Town Administrator Patrice Garvin announced that Article 10 would put an end to civil service in the Belmont Police and Fire departments. (The warrant will be finalized on Aug. 31.)

“This has been talked about for some time since I’ve been here, and we felt this was a good time to bring this forward given the financial climate and some of the social climate that’s going around town,” said Garvin, at the end of another marathon Select Board meeting on Monday, Aug. 24.

A public meeting on the article will be held on Sept. 9, said Garvin, whose office will manage the meeting.

Garvin has sent notices out to all union presidents that the town will bargain “in good faith” under the state’s collective bargaining law.

But in a twist to the bargaining process, the board and Garvin will go first to Town Meeting “to see if [it] is interested in removing it and then go to the bargaining table” as opposed to a more traditional negotiating away civil service first and then seek Town Meeting’s approval.

The civil service system in Massachusetts was created in an attempt to end the corruption, patronage, and cronyism that dominated all types of government in the late 1800s when it was who you knew not your qualifications that determined who was hired for a government position. Critics say the civil service laws represent a significant barrier to efficient government operation while its defenders contend it has taken the politics out of municipal jobs especially for the police and fire departments.

While the overwhelming number of Massachusetts cities and towns adhere to civil service rules, Burlington, Lexington, Reading, Wayland, Wellesley and Westwood are some of the nearly 30 municipalities which are not covered by civil service.

While there haven’t been any recent attempts to revoke civil service in town, the topic has been raised periodically by previous town administrations and Select Boards. It resurfaced in the past year specifically during the hiring process of the new police chief and during the current search for a fire chief.

During his public interview for the job, James MacIsaac, Belmont’s current police head, was emphatic that civil service should be taken off the table, saying it would prevent him from hiring qualified residents from a larger pool of candidates and limit placing people of color onto the force as he is required to take the first name off a list of test-takers presented to him by the civil service board.

The members of the current Select Board have in the past expressed qualified support to bring a measure before the town’s legislative body for a vote and did so on Monday.

“A lot of people have been telling us to do more structural change so there you go,” said Adam Dash, a member of the board.

“The people most directly involved with it, namely the police and fire chiefs think this is a very desirable thing to do,” said Roy Epstein, chair of the Select Board.

But the defenders of civil service are beginning to rally their supporters. At nearly the same time Garvin presented the article at 10:40 p.m., firefighter’s local union 1637 was on social media with a notice whose headline screamed: “Protect The Public From Politics!”

“The rank and file members of the Police and Fire departments feel this is not something that would benefit the town in any manner,” read the email pamphlet.

And the town certainly realize they will have a fight on its hands.

“I definitely think we’ll get some push back [from the unions],” said Garvin. But it is worth exploring especially if the outcome of a yes vote are departments with greater diversity and in future years a larger pool of employees of color in senior positions, she noted.

While this Special Town Meeting warrant is filled with articles that were not taken up during the annual Town Meeting in June, there is one which could prove to be just as contentious. The board will likely approve an article to purchase the two trailers the police department has been using as its temporary headquarters for the past year on Woodland Street.

With its single floor open-design plan, the 5,000 square-foot modular trailers have been a hit with the police – early in the year one senior officer said the department would have been happy to have them set up as its permanent headquarters – the town is viewing the modulars as a solution for the threadbare condition of the nearby Water Department.

“The trailer are in really good condition, we can utilize some offices down there,” said Garvin. “It’s an opportunity for the town to acquire an asset and for the Water Department to use it.”

With potential savings by not making payments and eliminating the moving and disassemble fee, “there’s a high upside for keeping those buildings knowing that there’s a space crunch [in town departments],” said Jon Marshall, assistant town administrator. “There are some departments in town that are actually renting space … so there’s certainly an opportunity to put people in spaces that makes sense.”

But board members noted that several neighbors along Woodland Road were told the trailers would be temporary as they worried about police traffic at the site.

“I’m not saying I’m opposed to it but I think there will be a lot of push,” said Dash.

Other articles coming before the Special Town Meeting will include:

  • Adopting private street Carleton Circle as a public way.
  • Authorize the Select Board to grant temporary easements for the Wellington Elementary’s “Safe Routes to School” plan.
  • Vote on several Community Preservation Committee projects including $680,000 for Town Field Playground renovation and $100,000 to repair the front steps at the Police Headquarters.
  • Reallocating water and sewer capital balances towards other capital projects.
  • Vote to approve changes to the zoning bylaw to allow for the construction of residential housing in a portion of the McLean Hospital property.

Belmont PD: Suspect Sought In July McLean Fire

Belmont Police is seeking information on a suspect who allegedly started a fire at McLean Hospital on Wednesday, July 29.

In a press release dated Aug. 5, Belmont Asst. Police Chief Mark Hurley said Belmont 911 received an alarm at 3:03 p.m. for fire and/or smoke in the administration building at 115 Mill St. Belmont Fire quickly responded and extinguished the blaze.

An investigation utilizing the hospital’s security surveillance cameras revealed a man entering the front door of the building. Once inside, the suspect begins spraying and pouring an unknown substance on the carpeted floor from a handheld container. He then ignited the substance and fled the area.

The suspect is described as a male wearing brown dress shoes, blue pants, a long-sleeve button-down shirt, a surgical mask and sunglasses.

Belmont Center Parking Meters Back In Operation Beginning Friday

The days of free parking throughout Belmont Center will come to an end beginning Friday, July 17, after a vote by the Belmont Select Board at its remote meeting on Monday.

“It’s a return to normality,” said Board Chair Roy Epstein as the members voted unanimously to honor an “explicit” request by the Belmont Center Business Association to reactivate the pay stations for parking spaces on Leonard Street, Moore Street, Alexander Avenue and Channing Road.

The ask from the business group came after their members observed many of the spaces being used by people leaving their vehicles all-day at prime locations. Paid parking in Belmont Center was suspended along the street and in the Claflin Municipal Parking Lot behind the center as a way to help merchants during the slow down during the COVID-19 pandemic.

The Board also decided to keep free parking in the Claflin lot through Labor Day.

Long Serving Belmont Fire Chief Frizzell Set To Retire In August [Update]

The cat is out of the bag on the future of Belmont Fire Chief David L. Frizzell.

Last week, Select Board Chair Roy Epstein casually mentioned at a public meeting that Frizzell “would be leaving” his position this year. The long serving member of the Belmont Fire Department confirmed the rumor before the start of the Class of 2020 Rolling Rally on Saturday.

At the Select Board’s meeting on Monday, June 8, Town Administrator Patrice Garvin said it was with regret that Chief Frizzell was indeed retiring “after a long and distinguished career.”

Frizzell’s final day will be Aug. 28 or 31, according to Jessica Porter, Belmont Human Resources director.

“It’s been a great time, been a great job, the best job in the world,” said Frizzell.

“I loved working for the town, had a great bunch of of people under me that made the department a success and I’ll be moving on to the next chapter,” he said.

Son of a Belmont Fire Department captain – David M. Frizzell – Chief Frizzell has been leading the department for the past 16 years since his appointment in June 2004, after serving seven years as assistant chief.

Frizzell’s first position in Belmont was as a part-time police dispatcher in 1985 before joining the fire department as a full-time Fire Alarm Operator (dispatcher) in 1986. He was appointed a firefighter in March 1988.

A graduate of Minuteman Vocational High School, Frizzell received two associate degrees from Middlesex Community College and his bachelor’s and a Master in Public Administration from Anna Maria College.

In February 2019, the Belmont Select Board agreed to extend Frizzell’s contract until June 30, 2021.

It is unknown how the town’s hiring freeze will impact the search for and appointment of Frizzell’s replacement.

Letter To The Editor: Chief MacIsaac Discuss George Floyd’s Death And Future Of Trust

On Thursday, May 28, I received an email from a Belmont resident who, in light of George Floyd’s death at the hands of a police officer, felt it was necessary to ask me a few questions to proactively ensure the safety of Belmont’s minority citizens. I immediately answered the residents email. I have since heard from others with similar concerns, so I believe it is necessary for me to write this letter.

I watched the video of George Floyd’s death with dismay. As a police officer and former use-of-force instructor, I was sickened by the video. Speaking for the Officers at the Belmont Police Department, I can say that they, too, found the video disturbing. The death of George Floyd runs counter in every way to the values of democracy, justice, and fundamental fairness. Any officer who is not upset about the death of George Floyd, or seeks to justify the unjustifiable, should leave the profession of law enforcement.

Please know that our officers work very hard to build and maintain trust within our community. Our number one goal is to provide excellent, fair and impartial police services to the community of Belmont. Over the years, leadership at the BPD has infused an ethos into our Department requiring that all citizens and visitors to Belmont that we encounter receive fair, equal and compassionate treatment. Maintaining and cultivating this culture is our number one priority.

The most effective way we can build trust between the police and the community is for us to get to know one another.

Our officers are aware of the differences of explicit and implicit biases and have received annual training on how biases can affect their interactions with others. Belmont Police Officers are trained in de-escalation techniques that include de-escalating incidents involving people in crisis, people living with addiction, and people with autism.

The circumstances of the George Floyd death will and should cause police organizations across the country to take a hard look at their officers and their organizational cultures to prevent these kinds of tragedies from happening in the future. I can assure you that the Belmont Police Department fully embraces the six pillars of the principals found in President Obama’s Task Force on 21st Century Policing.

The Belmont Police will continue our partnerships and collaboration with existing and future groups that seek to bring social justice within our community. I have never been more proud of officers and our team at the BPD. At no time during my career, can I recall us having a group of professional and community minded officers like the ones that fill our ranks today. I will be attending each roll call in the coming week to discuss the incident in Minneapolis with our officers and to share the concerns that residents have expressed to me.

The most effective way we can build trust between the police and the community is for us to get to know one another. I, and the members of the Belmont Police Department, will always make ourselves available to anyone who has concerns or questions regarding operations, tactics and how we interact with the public.

As a police officer, it is heartbreaking to me when I learn that there are people in our community that fear the police. We will make every effort to alleviate that fear and build trust within the Community of Belmont.

Early Morning Smokey Fire Damages Purecoat Plating Plant on Hittinger

An early morning two alarm fire involving chemicals used in the plating process occurred at the Purecoat North facility adjacent Belmont High School property at 39 Hittinger St. on Friday, May 28.

Belmont Fire Chief Divid Frizzell said in a press release that a call was received by Belmont Fire from Purecoat’s monitoring company at 12:51 a.m. reporting a fire alarm activation at the location. All on-duty Belmont personnel and apparatus responded. 

Upon arrival there was a large amount of black smoke coming from the building, involving equipment, chemicals and storage vessels used in the plating process. Due to the nature of the chemicals at the site – that can include solvents such as:

  • Benzene
  • TZE
  • Trichloroethylene
  • Methylene chloride
  • Tetrachloroethylene (perchloroethylene)

a second alarm was transmitted which brought local aid from Arlington, Cambridge, and Watertown to the fire while Waltham Fire covered one of Belmont’s stations. 

The fire was brought under control in about 30 minutes. The Massachusetts District 2 Hazmat Team had a Tier 1 response to the location to check for hazardous materials. They found the chemicals were contained inside the protective barriers within the building. 

The building was unoccupied at the time of the fire and there were no injuries to firefighters. The cause of the fire is under investigation and a dollar loss has not been established.

Belmont Police Names Hurley New Assistant Chief

The Belmont Police Department announce the promotion of Lt. Mark Hurley to the position of Assistant Police Chief.

“His promotion was the first step our plan towards creating a command staff that is invigorated and eager to take on new challenges and ideas,” said Belmont Police Chief James MacIsaac.

Hurley will be responsible for planning, administration and operations of the department. In addition to fulfilling all the duties of the second in charge of the department, the Assistant Chief directly oversees the Detective Division, Community Service Division and Joint Public Safety Communication Division E911.

Hurley began his career with the Belmont Police Department in 1998. He was promoted to Sergeant in 2007 and Lieutenant in 2014.

A 1989 graduate of Belmont High School, Assistant Chief Hurley holds a Bachelor of Arts from UMass Boston and Master’s Degree from Western New England College.

Victim ID’d In Birch Hill Road Blaze, Fire Alarms Found Not To Be Working

A pair of non-working residential fire alarms were a likely factor resulting in the death of a woman on Birch Hill Road last month, according to Belmont and State Fire officials.

While the cause of the 4 a.m. blaze on April 24 officially remains “undetermined,” it appears the fire was accidental, said Belmont Fire Chief David Frizzell and State Fire Marshal Peter Ostroskey in a joint statement on May 8.

“Fire investigators determined the fire started in the kitchen. They found no signs of an intentionally set fire. There was evidence of several potential accidental causes, but not enough to narrow it down to one most probable cause. Therefore, the fire will remain officially undetermined,” said the release.

Middlesex District Attorney Marian Ryan has identified the victim as Alison Bane, 55, who was the only occupant of the house. Bane, who previously lived in Arlington and Maine, graduated from Boston College in the 1980s with a BA and a law degree and practiced in Maine. The house is owned by a trust in her parents’ name.

There was one minor firefighter injury. A cat was rescued from the house and is being taken care of. Damage to the split-level single-family home is estimated at $150,000.

Frizell said first arriving firefighters did not hear any smoke alarms sounding. During the investigation, one battery-operated alarm on the lower level of the home had no battery and appeared to be of 1980s vintage. Pieces of a similar style smoke alarm were found on the second floor, but it may not have actually been installed. There were no carbon monoxide alarms in the home.

“It is important to replace smoke alarms … every ten years. Like every other appliance in your home, they do not last forever,” said Frizzell. “Time is your enemy in a fire where you may have less than three minutes to escape. Expired alarms cannot be counted on to work in a fire.”

Ostroskey said the Belmont incident was the second fatal fire in April where the smoke alarms were decades old and failed to work when residents needed them most.

“I urge everyone to take the time this spring to ensure all smoke alarms that need them to have fresh batteries and replace any alarms that are more than 10 years old.” he added.

“Ask yourself, ‘when did I last replace these smoke alarms? Were they here when I moved in?’ Smoke alarms made in the last decade have a date stamped on them. Older alarms do not.”

Investigators from the Belmont Fire and Police Departments and State Police assigned to the Office of the State Fire Marshal and to the Office of the Middlesex District Attorney jointly investigated the fire. The Department of Fire Services’ Code Compliance Unit provided assistance.

One Dead In Birch Hill Road Fire That Leaves House Heavily Damaged

A female resident died after being rescued by Belmont firefighters during an early morning blaze that heavily damaged a split ranch house at 81 Birch Hill Road on Friday, April 24.

The unidentified victim was discovered by firefighters in cardiac arrest in the 60-year-old structure located near Lantern Road and abutting Hinckley Way, according to Belmont Fire Chief David Frizzell.

The victim, described as not being the homeowner, was taken by Belmont ambulance to Mt. Auburn Hospital in Cambridge where she was pronounced dead.

The fire is under investigation by the Belmont Fire and Police departments. As there was a death caused by the fire, the Massachusetts State Police, the State Fire Marshal, and the Middlesex District Attorney are part of the probe.

The fire was phoned in at approximately 4:09 a.m. by a motorist driving on Route 2 who reported it five minutes after first seeing smoke coming from the structure, said Frizzell.

Firefighters arrived to find heavy smoke coming from the attic windows, which resulted in a second alarm being called. Fire personnel discovered the fire on the first floor in the area of the kitchen which had raced up into the attic, said Frizzell.

It took about half an hour to put out the fire. Firefighters remained at the scene to search for any smoldering flames. A cat was found under a bed in the basement and handed over to Belmont Animal Control, said Frizzell.

Frizzell said the structure while heavily damaged “was by no means a total loss” with the most fire damage in the kitchen area and in the attic floorboards.

Belmont Engines 1 and 2, Ladder 1 and Rescue 1 fought the fire while Arlington and Cambridge’s Fire assisted at the scene. Waltham and Watertown provided covered at Belmont’s firehouses.
